A trial was set for January 5 and attorneys on both sides said they expect it to last two to three days.
Comey on Wednesday pleaded not guilty in Alexandria, Virginia, to charges of providing false statements and obstructing a congressional proceeding. He could face a maximum of five years in prison if convicted.
Comey plans to ask the judge to throw out the charges based on his claim that they were unfairly brought.
Comey’s team also plans to challenge the appointment of the prosecutor in Virginia who brought the charges against him, Lindsey Halligan.
