The Supreme Court ruled 5-4 AGAINST President Trump’s EO limiting birthright citizenship from children of illegal immigrants.

Told you guys it was a steep mountain to climb… Trump knew this. Two options left:

1. What SHOULD HAPPEN— The better and more PERMANENT solution — a constitutional amendment (2/3 vote in both houses of Congress + ratification by at least 38 states). This is extremely difficult.. and ironically, such a legislative attempt exists right now — the Birthright Citizenship Act of 2025 (H.R. 569), which seeks to redefine “subject to the jurisdiction” in statute. It was introduced in January 2025 and referred to committee but has not advanced significantly.

2. If the above fails, the only other way is the Military. President Trump, as the Commander in Chief has the duty to use the full force of the U.S. Military to take over.

SCOTUS rules 5-4 that President Trump's birthright citizenship order is unconstitutional. Chief Justice Roberts wrote the majority opinion — joined by Sotomayor, Kagan, Barrett, AND Jackson. Thomas, Alito, and Gorsuch dissented. Birthright citizenship stands.

Update: President Trump himself shared this piece on Truth Social the morning of the ruling, hours before the Court came down 5-4 against his executive order. With that route now foreclosed, attention shifts to Congress, the Birthright Citizenship Act and the BACK OFF Act targeting birth tourism being the most notable bills already in play. Either would face its own steep climb to passage and its own constitutional challenges, a much higher bar than an executive order, but it’s the road that remains open.

The DOJ directed federal prosecutors to prioritize investigations of birth tourism schemes after the Supreme Court ruling on birthright citizenship.

A senior ​Justice Department official, Colin McDonald, told employees in a memo that people who ​come to the United States under "false pretenses" to give birth and secure ⁠citizenship for their child could be criminally charged under laws barring visa fraud, money ​laundering, identity theft and wire fraud.
