Chief U.S. District Judge James Boasberg issued a temporary 120-day standing order on March 4, 2026, requiring written notification to the duty magistrate judge whenever a grand jury declines to indict in a GJO investigation. Notifications will be kept confidential in the Clerk's Office while the court considers making the rule permanent.
The order follows a failed February 2026 attempt by U.S. Attorney Jeanine Pirro to secure federal indictments against six Democratic lawmakers — Reps. Jason Crow, Maggie Goodlander, Chris Deluzio, and Chrissy Houlahan, along with Sens. Mark Kelly and Elissa Slotkin — over a November 2025 video encouraging military and intelligence personnel to refuse unlawful orders.
President Trump had labeled the group the "seditious six" and pushed for prosecution, but the grand jury declined. Pirro has since called Boasberg an "activist judge," a tension that has extended to other disputes, including Federal Reserve subpoenas.
